New Occupational Health Safety (OHS) Harmonisation legislation will come into effect across Australia in 2012. There will be significant changes to the regulation of workplace safety in Australia, with harsher penalties and significantly increased fines. This will mean greater risk exposure for all those involved who do not meet the new requirements.
The new OHS legislation creates risk exposures some of which are not insured under existing D&O and Statutory Liability policies.
Aon's unique solution
Aon has developed a unique OHS Liability insurance product that has been designed specifically around the new legislation. This product fills certain gaps that exist within conventional policies.
Features of Aon's OHS Liability Insurance
The policy is triggered by a notifiable incident, threatened or actual action by a Workplace Safety Authority or a fatality.
The policy gives access to legal and related costs from the time a notifiable incident, threatened or actual action by a Workplace Safety Authority or a fatality occurs and the claim is reported to insurers.
D&O policies are predominantly designed to protect an organisation's Directors and Officers, whereas the Aon OHS Liability insurance extends to cover the company and its employees, with an optional extension to cover contractors and on-hire labour staff.
Cover for insurable fines and penalties which have significantly increased under the legislation:
